i think you are right it would be more appropriate to write it as $\phi$

see  ϕ and { }  are same which means set has no element but { ϕ } means set has one element which is ϕ.

It should be the empty set ϕ because intersection with empty set always gives an empty set whereas {ϕ} is not empty
